What are statutory declarations?
Statutory declarations are versatile documents that you may need to provide for a range of situations. They act as a formal statement and declaration of facts where the person who has made the document, declares that what is said within the statement is true to the best of their knowledge.
Although they are very similar documents, statutory declarations should not be confused with affidavits, which are only ever used for legal proceedings. Statutory declarations have a much broader use than affidavits. However, both will need a lot of the same information and they will both need to be drafted.
There are even subtypes of statutory declarations, such as the declaration of solvency or the declaration of marital or civil partnership status. These act the same as any other statutory declaration, but they simply have a different name due to the circumstances they are used for.
Why do I need a Notary Public?

As we have previously mentioned, there are many different types of situations where you might need to make a statutory declaration. Both businesses and individuals can make use of statutory declarations.

- Declaration of solvency for people or businesses to state they have repaid their debts
- Declaration of insolvency to state that someone can no longer repay their debts
- To declare a change of gender
- For a declaration of name change
- The aforementioned declaration of marital or civil partnership status
- To declare your nationality

How do I draft a statutory declaration?
The core aspects of a statutory declaration that need to be included when it is drafted are:
- Name of the declarer
- Declarer’s address
- Statement of the person making the declaration
- Affirmation that the statement is true to the best of the declarer’s knowledge
- Signature of the declarer and their witnesses
There may be other bits of important information that you need to include if you have, for example, ever gone by any other names in the past. In this case, you will need to include those names.
